Terms of Service

These Terms govern your use of Lumina (the "service") at https://lumina.jamesconary.com. By creating an account or using the service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use the service. By using it, you confirm that you meet this requirement.

2. The service

Lumina is an AI-powered language-learning tool offering a real-time voice tutor and AI-generated lessons and quizzes. We may change, add, or remove features over time.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and let us know of any unauthorized use.

4. Subscriptions, billing and renewals

The service offers a free tier and paid plans (Pro and Premium), billed monthly or annually. Payments are processed by Paddle, which acts as the Merchant of Record.

Paid plans renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. Applicable taxes may be added at checkout.

5. Cancellation and refunds

You can cancel at any time from Profile → Billing (in-app cancel or the Paddle billing portal). When you cancel, you keep access until the end of your current paid period, and it will not renew afterward.

Except where required by law, payments are non-refundable. Refund requests are handled by Paddle in line with its buyer terms.

6. Fair use and voice limits

To keep the service sustainable, voice-tutor minutes are subject to per-plan limits (for example a daily allowance on the free tier and a monthly allowance on Pro). We may adjust these limits and will reflect them in the app.

7. Acceptable use

You agree not to misuse the service, including: attempting to break, overload, or reverse-engineer it; using it for unlawful, harmful, or abusive purposes; or sharing another person’s data without permission.

The AI is for learning and practice. Do not rely on it for professional, legal, medical, or financial advice.

8. AI-generated content

Lessons, corrections, and conversations are generated by AI and may be inaccurate or incomplete. We do not guarantee any particular learning outcome. Use your judgment and verify important information.

9. Intellectual property

The service, its software, and its branding are owned by James C. Yarbrough and protected by law. We grant you a limited, personal, non-transferable license to use the service. Content you enter remains yours.

10. Termination

You can stop using the service at any time and delete your account from Profile → Danger zone. We may suspend or terminate accounts that violate these Terms or the law. On deletion, we erase your personal data as described in the Privacy Policy.

11. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law (including your statutory consumer rights).

12. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by the date above and, where appropriate, notified to you. Continued use after changes take effect means you accept them.

13. Governing law

These Terms are governed by the laws of New York, United States, without prejudice to mandatory consumer-protection rights you have where you live.
